Murder suspect Joran van der Sloot files $10 million lawsuit against South American authorities–and murder victim’s father
Joran van der Sloot, the man still suspected of murdering disappeared American student Natalee Holloway in Aruba, has filed a lawsuit against authorities with the Chilean and Peruvian government as well as Richard Flores, the father of a second murder victim whom van der Sloot is suspected of slaying. Van der Sloot's suit, which seeks $10 million in damages, alleges that the defendants violated his human rights as he was investigated for the murder of Stephany Flores.
The 24-year-old van der Sloot is alleging that Chilean authorities violated his rights during his forcible extradition from Chile to Peru to face murder charges in the May 30 killing of Flores, a 21-year-old Peruvian business student, who was found dead in van der Sloot's hotel room in Lima on June 2, 2010.
Van der Sloot has been charged with first-degree murder and robbery in the Flores case after his prior indictment by the U.S. government on charges of attempting to extort $250,000 from Holloway's family in exchange for information on her death and the alleged location of her body.
The Huffington Post's David Lohr explains the charges in van der Sloot's lawsuit:
The lawsuit alleges there was "pressure from the then-President of the Republic Alan Garcia Perez" to have him extradited. The suit further argues that police in Chile denied van der Sloot access to a telephone or computer so he could communicate with his family and alleges he was "deprived of his right to counsel."
In addition to Perez, the lawsuit implicates former Peruvian Minister of Interior Octavio Salazar, former police generals Miguel Hidalgo and Cesar Guardia, and Ricardo Flores, the father of murder victim Stephany Flores.
Peruvian officials claim van der Sloot made a full confession to the murder of Flores, claiming he broke her neck after catching her using his computer to research his involvement in the Holloway murder case. Van der Sloot later retracted the confession, saying it was made under duress.
"I did not want to do it," van der Sloot allegedly said about the attack. "The girl intruded into my private life. ... We argued, and she tried to escape. I grabbed her by the neck, and I hit her."
A confidant of the van der Sloot family claimed yesterday that Joran was suffering from post traumatic stress at the time of Flores' murder.
The Peruvian government dismissed an earlier lawsuit from van der Sloot, who claimed he was arrested without a warrant and not given access to a translator while being pressured to confess to Flores' murder. "All this with the intention of pressuring me to accuse [me] of homicide," van der Sloot said in court documents.
Van der Sloot faces up to 30 years in prison if convicted, with his trial set to start just after the New Year on Jan. 6.

The petition was filed in June by Dave Holloway, Beth Holloway's ex-husband. It will be heard in a Jefferson County, Alabama, probate court on Friday.
Natalee Holloway was 18 and had just graduated high school in the Birmingham, Alabama, suburb of Mountain Brook when she disappeared on a celebratory trip with classmates to Aruba in 2005.
"Beth intends to oppose Dave's inexplicable effort to have Natalee declared dead," attorney John Q. Kelly said in a statement. "Beth gave birth to and raised Natalee, and will always hope and pray for Natalee's safe return."

"This is a normal proceeding for families when a loved one has been missing for an extended period of time," attorney Karen Hennecy said in a statement. "Alabama law requires a waiting period of five years when a body has not recovered and no death certificate has been issued."
"If Dave seeks closure on such a personal and sensitive matter, it should be respected, but not imposed upon Beth in such an adversarial and public manner," Kelly said Thursday.
Beth Holloway said in a statement last week, issued through her Natalee Holloway Resource Center, which aids families of missing persons, that she learned about the filing when she was handed documents by a process server while addressing a conference in Georgia.
Natalee Holloway's disappearance remains unsolved. A suspect, Joran van der Sloot, was arrested but never charged in connection with the disappearance. He was indicted on federal extortion charges last year after prosecutors accused him of offering to sell information about the location of Holloway's remains in exchange for $250,000.
Van der Sloot is awaiting trial on murder charges in Peru in the death of a woman whose body was found in his hotel room last year. If convicted, prosecutors have said, he faces a 30-year prison term

Woman's family wants speedy trial for van der Sloot
CNN) -- The family of a slain Peruvian woman is urging prosecutors to file their case against murder suspect Joran van der Sloot, warning that he may be released by December unless the case goes ahead.
"We are worried because Peruvian law says that if a suspect's trial doesn't begin within 18 months after his arrest, authorities are obligated to set the suspect free," Ricardo Flores, the dead woman's father, told CNN.
Van der Sloot faces charges in the May 2010 killing of Stephany Flores, who was found dead in his Lima hotel room. Police say van der Sloot took money and bank cards from her wallet and fled to Chile, where he was arrested a few days later.
Investigators delivered their case file to prosecutors in June for a decision on charges. Ricardo Flores said the prosecutor in the case, Miriam Riveros Castellares, is "not moving with the speed that a case of this magnitude merits."
"We're asking that either the prosecutor file charges or that authorities remove her from this case and name somebody else," he said.

There was no immediate response to the family's concerns from the prosecutor's office.
Van der Sloot was once the prime suspect in the disappearance of Alabama teenager Natalee Holloway, who vanished while on a graduation trip to the Caribbean island of Aruba. He was arrested twice but never charged in connection with Holloway's disappearance, which remains unsolved.
His lawyers have asked that prosecutors consider charging the 24-year-old Dutch national with the Peruvian equivalent of manslaughter, rather than murder, in Flores' death.
Flores said van der Sloot "didn't look remorseful" the last time he saw him in court.
"He had an indifferent and prideful attitude. He looks as if he has everything under control. He looks better than when he appeared on TV after he was arrested," the victim's father said.

(CBS/WIAT) Joran van der Sloot is looking for a lawyer days before a murder hearing.
According to CBS affiliate WIAT, Max Altez, van der Sloot's Peruvian lawyer for the past year, has quit the case citing differences in defense strategy. Radio Netherlands Worldwide indicates there was also an issue of Altez not being paid.
CNN reports that Altez' made an official request to a judge to withdraw from the case Tuesday morning.
Altez's resignation comes at a particularly inopportune time for van der Sloot. A hearing in the murder of Stephany Flores is scheduled for June 8.
Van der Sloot reportedly confessed he killed Flores after she found material relating to Natalee Holloway on his laptop.
The body of the 21-year-old student was found in van der Sloot's Lima hotel room five years to the day after Natalee disappeared while on vacation in Aruba. Although van der Sloot is considered the prime suspect in the Holloway case, he was never charged by Aruban authorities.
According to WIAT, it is unclear who will represent van der Sloot at the June 8 hearing or whether Altez' resignation will be sufficient for van der Sloot to get a continuance. Altez has indicated he will continue to represent van der Sloot in a related case claiming human rights violations during his arrest in Chile and return to Peru. That case would be thrown out if van der Sloot's representation changes.

Joran van der Sloot, the Dutch man accused of bludgeoning and strangling to death a young Peruvian woman and the principal suspect in the disappearance of Alabama teenager Natalee Holloway, is believed to have got his girlfriend pregnant - while behind bars.
Van der Sloot - son of a wealthy Dutch judge - is currently being held at Miguel Castro Castro Jail in Peru where he awaits the murder trial for the death and robbery of Stephany Flores in June 2010.
It is believed that his girlfriend - who has not been identified - has been visiting the 23-year-old frequently for conjugal visits at the jail, going to his cell to do 'chores' and bringing him candy.
According to the Atlanta Journal Constitution, van der Sloot uses the candy to run a 'lucrative' snack bar from his cell.
It is also believed that the girl worked at the casino which Stefany Flores was in the night van der Sloot allegedly murdered her by strangling and suffocating her.
He has admitted to the murder but has pleaded 'violent emotion' - which is typically used in Peru for crimes of passion.
The victim’s father, Ricardo Flores, saw van der Sloot at a recent court hearing and said he expected to see a 'miserable person' but instead was was shocked to see a 'fatso'.
He has asked jail officials to investigate the conjugal visits.
It recently emerged that the 23-year-old was so desperate for money he allegedly told a friend he was going to work on the streets.
The National Enquirer said van der Sloot made the claims in a 44-minute exchange of emails between himself and a friend.
He told the friend he had unsuccessfully asked his wealthy family for a lend of money but they refused because they thought he would spend it on gambling.
Van der Sloot could spend just 20 months in jail if a judge accepts his defence of 'violent emotion', entered in March.

He is currently accused of first-degree murder, and faces a 15- to 35-year sentence if his plea is not accepted.
Van der Sloot signed a confession last year where he described slamming Miss Flores in the face with his right elbow, strangling her for a full minute then taking off his shirt and asphyxiating her.
He has said that it was Miss Flores that attacked him first.
He has several times confessed then recanted a role in the disappearance of Miss Holloway, an 18-year-old Alabama student who was visiting Aruba in 2005 on a high school graduation trip with classmates when she vanished.
Her body has never been found, and Van der Sloot, who she met on the island, was the last person to be seen with her.

Miss Holloway's mother, Beth Twitty, has been desperate to find information on her daughter's disappearance, and was given fresh hope last year when FBI agents travelled to Peru to examine van der Sloot's laptop.
But hiss attempt to plead 'violent emotion' in March angered Ms Twitty. At the time her lawyer, John Kelly, said she called Van der Sloot’s plea plan 'outrageous'.
She said she knows that the Flores family will never accept it and will ‘make whatever noise she has to’ to make sure it doesn't happen.
Whatever decision is ultimately made by the Peruvian court hearing the case, Van der Sloot still faces prosecution in the U.S. on wire fraud and extortion charges.
He was recently indicted by an Alabama grand jury for allegedly trying to extort $250,000 from Mrs Twitty in exchange for information on where she could find her daughter's body.
According to court papers, Van der Sloot received a total of $25,000 a few weeks before Miss Flores' death – which it is believed he used to travel to Peru.

The Dutch and Peruvian governments have recently signed an extradition treaty which allows a prisoner exchange pact that could allow Joran to serve out his time in Holland.
But his case received another set back on May 31 after his defence lawyer quit after he received death threats and fell out with his client over something in the case.
Last year Mrs Twitty sneaked into the Peruvian jail with a hidden microphone to confront van der Sloot face to face over her daughter's disappearance.
At the time she said: ' I wanted to see him, I wanted to get face to face with him. I wanted to peel the skin off his face. I'm thinking this is it, this is my one chance and I'll never get this chance again.'
But the meeting did little to give her the answers she craved. After four minutes of silence he spoke only briefly, saying: 'I hope you can understand it's very hard for me to talk to you. It's really not easy, I'm really doing my best.
I know you have a very good heart, I know that for a fact. It is the least I owe you for sure. I've made so many bad decisions and all for the wrong reasons.'

Van der Sloot spent almost an hour on the phone with a Dutch friend on May 28, 2010….two days before he met and killed Stephany Flores.
Van der Sloot told his friend he was broke and couldn’t pay his hotel tab at Lima’s TAC hotel where he had been for five days playing in a poker tournament. The call to Stan Pluijmen was later listened to by Dutch police.
During the forty four minutes the two talked about business plans that apparently involved $25,000 van der Sloot got from the Holloway family in exchange for information about Natalee’s fate. It had been just days shy of five years since Natalee disappeared on a graduation trip to Aruba. The Mountain Brook teen was last seen leaving an Oranjestad bar with van der Sloot.
Van der Sloot never came across with any information after taking the Holloway’s money. That’s the basis of the U.S. charges of wire fraud and extortion handed down by a grand jury here in Birmingham.
The call ended with van der Sloot asking Pluijmen to send him money saying his own mother and brother had turned him down saying all he’d do with it was play and lose at poker.
Sometime in the next two days, van der Sloot met a 21 year old Peruvian student named Stephany Flores who had just won almost 1800 euros at the casino. She mentioned to a friend that she had also met “a gringo”…who turned out to be van der Sloot.
Hotel security cameras show the two of them going into van der Sloot’s room. Flores never came out until her corpse left on a gurney.
Van der Sloot has admitted he killed Flores. But was it a crime of passion or a robbery/murder?
His story is that they argued after she saw Natalee-related material on his laptop. His legal defense is she was killed during an argument in the heat of the moment. If prosecutors accept a plea bargain on manslaughter, van der Sloot could serve as little as three years.
But the Peruvian newspaper El Commercio says the High Technology Division of the National Police have examined van der Sloot’s laptop and say the access to the Holloway information was between 1:25 pm and 6:45 pm the day before Flores died.
If that analysis holds up, it raises the ante considerably for van der Sloot. Murder in the course of a robbery can carry a life sentence in Peru.
There is a hearing scheduled at the Castro Castro prison June 8 where Stephany’s father, Ricardo Flores, is expected to identify objects that were owned by his daughter and were in van der Sloot’s possession at the time of his arrest in Chile.
Van der Sloot’s trial is expected within two months. The question is will it be for manslaughter or murder in commission of a robbery.

THE HAGUE, Netherlands — Under an agreement signed Thursday, Dutch murder suspect Joran van der Sloot could serve part of his sentence in the Netherlands if he is convicted of murdering a Peruvian student nearly a year ago.
The foreign ministers of the two countries agreed that Dutch prisoners in Peru and Peruvians jailed in the Netherlands can apply to complete their prison terms in their homeland once their appeal process has been completed.Peruvian prisons now hold 117 Dutch citizens, mostly serving time for drugs offenses. It was not immediately clear how many Peruvians are in Dutch jails.
Van der Sloot is awaiting trial on a first degree murder charge in the slaying of 21-year-old student Stephany Flores on May 30.
Van der Sloot, 24, also is a key suspect in the 2005 disappearance of U.S. teenager Natalee Holloway on the Caribbean island of Aruba.
Flores was killed five years to the day after Holloway disappeared. Her body was found in Van der Sloot's Lima hotel room, and a coroner's report said she had been bludgeoned and asphyxiated.
Under the accord, if a prisoner received a longer sentence in Peru than the maximum under Dutch law, the sentence would be reduced, the Dutch ministry said. But each country has the right to deny the prisoner's transfer request.
The deal signed must be approved by both countries' parliaments.

LOS ANGELES (AP) - Two brothers who were among the last people to see Natalee Holloway before her disappearance in Aruba can move forward with their defamation lawsuit against talk show host Phil McGraw.
City News Service reports Thursday that a Los Angeles Superior Court judge ruled that brothers Deepak and Satish Kalpoe can take their lawsuit to trial and set a trial date for Oct. 12.
The Kalpoes allege that following an interview for the "Dr. Phil" show, they were wrongly portrayed as drugging Holloway, having group sex with her and later helping kill her and dispose of her body.
The Alabama teen disappeared in the Caribbean island during a 2005 trip with friends and is presumed dead.
The Kalpoes were arrested and later released in the Holloway case.

Growing more arrogant about his professed innocence and finding himself increasingly in debt as his life and gambling habits spiral out of control, van der Sloot does the unthinkable by demanding $250,000 from Beth to reveal the exact location of Natalee's remains. Intent on bringing her daughter’s alleged murderer to justice, Beth once again partners with the FBI and other authorities to find and arrest him. But before they can, the saga takes another twisted turn when van der Sloot allegedly murders a young Peruvian woman on the fifth anniversary of Natalee's tragic disappearance.
